These Terms apply to the use of the app "Herbora" (the "App") and its related services operated by Wildemann Ventures (the "Provider").
Herbora is an AI-powered app for diagnosing and identifying plants from photos. The App offers:
The App's diagnoses are for guidance only and do not replace advice from a professional.
Herbora Premium is offered as a subscription:
All prices are final prices including statutory VAT. Outside Germany, the prices shown in the respective store in local currency apply. Billing is handled by the respective app store (Apple App Store / Google Play Store). Payment is due upon confirmation of the purchase.
New customers receive a free 7-day trial with the yearly subscription. After the trial, the subscription renews automatically as a paid subscription unless it is cancelled at least 24 hours before the end of the trial. The subscription price is clearly shown to the user before purchase.
Subscriptions renew automatically for the selected period (1 month or 1 year) unless cancelled at least 24 hours before the end of the current period. Cancellation is done in the settings of the respective app store:
Cancellation within the App itself is not possible. Cancellation takes effect at the end of the current period; amounts already paid are not refunded.
As a consumer you generally have a 14-day right of withdrawal. For digital content that can be used immediately after purchase confirmation, the right of withdrawal expires once performance of the contract has begun, provided the consumer has expressly agreed to this. By starting the subscription or the trial, you agree that the right of withdrawal expires when performance begins.
For iOS purchases, Apple's refund policies also apply. For Android purchases, Google Play's policies apply.
By purchasing a subscription, the user receives a simple, non-transferable right to use the App for personal purposes. Sharing, renting or otherwise transferring access is not permitted.
The Provider reserves the right to change the App, its features and prices with reasonable advance notice (at least 30 days). In the event of material changes to the user's disadvantage, the user has a special right of termination. The Provider does not guarantee uninterrupted availability of the App.
The Provider is not liable for damages resulting from incorrect or incomplete diagnoses. The App does not replace professional plant or mushroom identification. For mushrooms in particular: eat only after approval by a certified mushroom expert. The Provider is liable without limitation for intent and gross negligence and for injury to life, body and health.
